Comparative Fault in Idaho

Even if you were partially at fault for your accident, you may still be able to recover compensation. Idaho follows a comparative fault rule — meaning your recovery is reduced by your percentage of fault, but you can still recover as long as you were not more than 50% at fault. Do not assume you have no claim without speaking to an attorney first.

Uninsured and Underinsured Motorist Coverage

If the driver who caused your accident does not have insurance — or does not have enough insurance — you may still be able to recover through your own policy. Many auto insurance policies include uninsured motorist (UM) and underinsured motorist (UIM) coverage for exactly this situation. We will review your policy and help you identify every source of compensation available to you.

Steps to Protect Your Claim

Get medical attention immediately. Make sure your accident is recorded as the cause of your injuries. Be thorough and accurate with your doctor — do not understate or overstate your symptoms. Your medical records are critical evidence.

Document your expenses. Keep copies of all medical bills, prescription receipts, and any other costs related to your injury. Keep a record of missed work, mileage to medical appointments, and any other out-of-pocket expenses.

Preserve evidence. Photograph the accident scene, your injuries, and any damaged property. If there is a defective product or vehicle involved, do not allow it to be repaired or disposed of before we can examine it.

Collect witness information. Get the names, addresses, and phone numbers of anyone who witnessed the accident. Witness testimony can be critical to your case.

Do not give a recorded statement to the other driver’s insurance company without speaking to an attorney first. Insurance adjusters are trained to minimize what they pay you.

What Compensation Can You Recover?

A successful personal injury claim may include compensation for:

  • Medical expenses — past and future
  • Lost wages and loss of earning capacity
  • Pain and suffering
  • Emotional distress
  • Property damage
  • Wrongful death damages for surviving family members
